research(licensing): verify the Copilot litigation state (Doe v. GitHub et al.) before the policy doc cites it #6056
Parent: #6024 (licensing gate for the external corpus). Research source: prior-art doc ~/workspace/scratch/atlas-ingestion-brief-2026-11-04/prior-art-research.md (2026-11-04). Follow-up 35 (Cluster 6).
Why
The gate research cites the Copilot training disputes as context, not law: Doe v. GitHub/Microsoft/OpenAI saw most claims dismissed (2024), and no court has categorically held that training/indexing public code is fair use or infringement. That summary came from general knowledge and was explicitly not re-fetched during the research pass. Before the external-content policy (sibling decision under #6024) cites it in either direction, the docket state needs verification.
Scope
Current docket state: surviving claims, appeals, any rulings since the 2024 dismissals; any newer cases on indexing/embedding public content.
One-paragraph verified summary with sources, labeled with its as-of date.
Done looks like
The verified note linked from #6024; the policy doc cites only the verified version.
Expectation: done = findings below recorded; the docket verification itself is the scoped research pass, not done here (a triage must not substitute an unverified summary for the verification this ticket exists to produce).

Triage findings (verified fresh 2026-11-05)
held,user/owned,do-not-merge,do-not-auto-edit). No PR or other issue already carries the verified docket summary — the only comment on issue research(licensing): verify the Copilot litigation state (Doe v. GitHub et al.) before the policy doc cites it #6056 before this triage is its Kaneo tracker link, and the parent issue research(licensing): may we ingest external GitHub comments/discussions into Atlas? — gate for the external corpus #6024 research still cites the litigation state as context that was explicitly not re-fetched.
